JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-07-2017 The appellant seeks regular bail in connection with Buniyadganj P.S. Case No. 29 of 2017, registered for offences punishable under Section 376 of the Indian Penal Code, Section 12 of POCSO Act and Section 3(1)(w)(s) of SC/ST Act. It has been submitted on behalf of the appellant that now appellant has married the informant and they also have a son and they have settled the dispute, as such, the appellant may be allowed the privilege of regular bail.

Learned Special P.P. opposed the prayer for bail and submitted that there is allegation against the appellant for committing rape on the informant.

Having heard both sides, in view of allegations, I am not inclined to release the appellant on bail, this appeal is,

Patna High Court CR. APP (SJ) No.1705 of 2017 (2) dt.03-07-2017 2/2 accordingly, rejected.

However, the trial court is directed to expedite the trial and try to conclude it as early as possible and once the informant is examined by the Trial Court, the appellant will be at liberty to renew his prayer for bail.
