JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-04-2015 The petitioners seek anticipatory bail in a case registered for the offences punishable under sections 147, 148, 149, 366, 384, 323 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioners has drawn my attention to the statement of Ratan Devi, who is said to have been abducted, and submitted that the entire prosecution story is false. He appears to be right in his submission.
In view of submission, as above, the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be released on bail on furnishing bail bond
Patna High Court Cr.Misc. No.48063 of 2014 (2) dt.23-04-2015 2/2 of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Mahishi PS case No. 112 of 2010, subject to condition as laid down u/s 438(2) of the Code of Criminal Procedure.
