18-03-2015 Heard learned counsel for petitioners and Sri Arun Kumar Singh, learned Addl. Public Prosecutor. The present petition has been filed with a prayer to restore Cr. Misc. No. 23086 of 2011, which stood dismissed due to non-compliance of peremptory order dated 20-01-2014. By the said order, while admitting the petition, notice was directed to be issued in hearing matter to opposite party no. 2, for which, requisite was to be filed within peremptory time. Since the requisite was not filed, the petition stood dismissed. After hearing the parties and considering the ground set forth in the petition, same is allowed.
Let Cr. Misc. No. 23086 of 2011 be restored to its original file provided order dated 20-01-2014 is complied with within a period of two weeks, failing which, Cr. Misc. No. 23086
Patna High Court Cr.Misc. No.47317 of 2014 (2) dt.18-03-2015 2/2 of 2011 shall stand dismissed without further reference to a bench.
