2. The petitioner has preferred this application for grant of regular bail in connection with Katihar Cyber P.S. Case No. 22/2025 dated 22.05.2025 registered for the offences punishable u/ss 319(2), 318(4), 61(2) read with section 3(5) of the Indian Penal Code and sections 66 (C), 66(D) of the IT Act.

As per the prosecution case, the informant being a retired teacher has alleged that on 07.03.2025 one unknown person called her claims to be the staff of Treasury Office, Katihar and told the informant that he would send her dues amount to her account and after that telephonic call got cut. Later on 08.05.2025 she sent her son with cheque for

No.59961 of 2025(4) dt.16-10-2025 2/3 withdrawal of money then branch manager informed that her account has no sufficient balance while in her account there were total Rs. 41,00,000/- (Forty one Lakh) rupees but someone has illegally withdrawn Rs. 2349700/- from her account.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has no concern with the said mobile number from which the informant was called. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has two criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 07.06.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Katihar in connection with Katihar Cyber P.S. Case No. 22/2025, with the condition/s:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date,

Patna High Court CR. MISC. No.59961 of 2025(4) dt.16-10-2025 3/3 failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled. (ii). If the petitioner is found involved in similar nature of offence in future, the prosecution will be at liberty to move for cancellation of his bail bond.
