The petitioner seeks bail in connection with Mohiuddin Nagar P.S. Case No. 193 of 2021 instituted for the offences under Sections 341, 342, 323, 353 and 504 of the Indian Penal Code read with Sections 30(a) and 34 of the Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 06.09.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of recovery of 15 litres of liquor from the house of the petitioner.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 06.09.2021, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge, Excise, Samastipur in connection with Mohiuddin Nagar P.S. Case No. 193 of 2021.
