JUSTICE SUDHIR SINGH ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 25(1-A) (1-AA), 26 and 35 of the Arms Act and 420, 467 and 468 of the Indian Penal Code.

Allegation against petitioner is that the apprehended illegal arms dealers told that the arms were to be handed over to petitioner.

It has been submitted on behalf of petitioner that he has falsely been implicated in the present case. He is in custody since 11.9.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. Petitioner has been named in the F.I.R. on the basis of disclosure made by co-accused Dipu Kumar. There is no recovery of any incriminating article from possession of petitioner. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
