2. The petitioner apprehends his arrest for the offences alleged under Sections 498A and 494 of the Indian Penal Code registered in connection with Complaint Case No. 1087 of 2012.
3. It is submitted that the petitioner has been falsely implicated, this being the first complaint of its nature since parties were married 9 years ago. Moreover, even in the complaint petition there is no allegation whatsoever of demand of dowry and it is only because the complainant has two daughters.
4. Notice was issued to opposite party no.2 by order dated 11.11.2013 and served upon her and the matter, however was dismissed for non-prosecution on 05.02.2014. Prior to its
Patna High Court Cr.Misc. No.45055 of 2013 (7) dt.04-11-2015 2/2 restoration, notice was once again issued to opposite party no.2, who refused to accept the same. In that view of the matter, no further notice appears necessary to be issued to her.
5. Having regard to the entirety of the facts and circumstances of the case, in the event of the petitioner's arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Complaint Case No. 1087 of 2012, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
