JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 11-07-2022 Heard learned counsel for the petitioners and learned APP for the State and perused the case diary. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 467, 468, 420 and 120(B)/34 of the Indian Penal Code.

It is a case of selling the share of informant and his brother to the co-accused Radhesh Prakash.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that the informant has very cleverly not mentioned the land standing in the name of his father which is Khata No.966 and area 65 decimal and coming together the grand father of petitioner no.1 was given entire 34 decimal land of Khata No.1179 and informant and his brother Ashlok Chaudhary was given land of Khata No.966. He further submits that petitioner no.1 has sold land which was allotted to the share

No.71397 of 2021(3) dt.11-07-2022 2/2 of his grand father and he has committed nothing wrong but informant has filed this case against the petitioner and his mother (petitioner no.2) so that they may not claimed the land of Khata No.966 which is standing in the name of father of informant and he has filed this case for the land which is in the name of mother of the informant and petitioner will get share in both the Khata numbers as is evident from para-8 and 9 of the petition. Petitioners have got clean antecedent. Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-I, (West), Muzaffarpur in connection with Kudhani (Turki O.P.) P.S. Case No. 508 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
