JUSTICE SUDHIR SINGH ORAL ORDER 22-11-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with a case registered under Sections 420, 467 and 468 of the Indian Penal Code.

It is alleged by the informant (Pramilla Devi) that her ATM has been changed and on this information the police arrested the accused persons including this petitioner and after verification ten ATM cards were recovered from the possession of the petitioner.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 02.08.2016. Charge sheet has been submitted in this case. The petitioner has falsely been implicated in the present case. The allegation of fraudulent withdrawal of Rs.

Patna High Court Cr.Misc. No.50269 of 2016 (2) dt.22-11-2016 2/2 25,000/- is against the petitioner for which a separate case has been instituted. It is further submitted that the petitioner is ready to deposit an amount of Rs. 25,000/- in the court below, which shall be subject to final disposal of the case.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, the petitioner is directed to deposit an amount of Rs. 25,000/- (twenty five thousand) in the court below, which shall be subject to final disposal of the case.

Let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nawada in connection with Hisua P.S.Case No. 165 of 2016.
