The petitioner seeks bail in a case registered under Sections 302/34 of the Indian Penal Code.

Prosecution case, in short, is that on 24.05.2019 at 5 p.m. the informant received information that his sister, namely, Dharmawati Devi has been killed by her daughter-in-law, namely, Priyanka Devi and her ex-lover Pintu Giri (petitioner) by pressing her neck. Upon such information, the informant reached at the in-laws house of his sister and found dead body of his sister.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.05.2019 and has got no criminal antecedent. Charge sheet has been submitted in this

Patna High Court CR. MISC. No.56375 of 2019(2) dt.06-09-2019 2/2 case. There is no allegation of tampering of witnesses alleged against the petitioner. There is no eye witness to alleged assault which led to death of the deceased. Merely on suspicion, the name of the petitioner has transpired in this case. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Rasulpur P.S. case No.71 of 2019.
