JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-07-2017 This application is for grant of regular bail in connection with Patliputra P.S. Case No. 121 of 2017 registered for the offence(s) under section(s) 3, 4, 5, 6, 7 of the Immoral Traffic Act, sections 22/22 of the N.D.P.S. Act and sections 467, 468, 420, 294/34 of the Indian Penal Code.
Allegation, as per the FIR, is that the Police, on confidential information, raided the Hotel R.D. Inn, situated at Gosain Tola and found that the business of human trafficking is going on in that hotel and from there, one Punam Bhatia, who is involved in the aforesaid offence, was arrested. In the FIR, several persons have been named.
Submission of the learned counsel for the petitioner is that no specific allegation has been attributed against the
Patna High Court Cr.Misc. No.30999 of 2017 (3) dt.19-07-2017 2/3 petitioner, rather he is staff of the said hotel and he has clean antecedent and is in custody for three months. Further submission is that the co-accused, having similar allegation, have already been granted bail by different coordinate Benchs of this Court, vide order dated 10.7.2017, 6.7.2017 and 13.7.2017 passed in Cr. Misc. Nos. 28628, 29146 and 32514 of 2017.
Heard learned Additional Public Prosecutor also. Having heard both sides and in view of the facts and circumstances, as stated above, this application is allowed. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/-(Rs. Twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge/Special Judge, Patna in connection with Patliputra P.S. Case No. 121 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his
Patna High Court Cr.Misc. No.30999 of 2017 (3) dt.19-07-2017 3/3 part to appear before the court below on two consecutive dates without showing any genuine rhyme or reasons, the prosecution will have liberty to move for cancellation of his bail.
