JUSTICE PARTHA SARTHY ORAL ORDER 09-12-2019 Heard learned counsel for the petitioners and learned APP for the State as well as learned counsel for the informant. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Khaira P.S. Case No. 224 of 2019, registered for the offence punishable under section 272 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. As per allegation in the FIR, 936 litres of IMFL is said to have been recovered from a new house under construction, belonging to the petitioners and the father of the petitioners, who was taken into custody.
It is submitted by the petitioners that the only material
Patna High Court CR. MISC. No.71131 of 2019(4) dt.09-12-2019 2/2 that has transpired against the petitioners is the so called confessional statement of their father made before the police. The petitioners have no criminal antecedent.
Having heard the learned counsel for the parties and taking into consideration the fact of no incriminating article being recovered from possession of the petitioners and the petitioners not being apprehended at the spot, the above named petitioners are directed to surrender in the court below within a period of six weeks from today and in the event of their arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District Judge, 11th, Saran at Chapra in connection with Khaira P.S. Case No. 224 of 2019, subject to the condition as laid down under section 438(2) of the Cr.P.C.
