2. The petitioner has preferred this application for grant of regular bail in connection with Araria Sangram P.S. Case No. 12/2025 dated 26.02.2025 registered for the offence punishable u/s 115(2), 126(2) and 109 read with Section 3(5) of the B.N.S. and Sections 25(1-B)(a), 26, 27 and 35 of the Arms Act.

3. As per the prosecution case, 8-9 miscreants riding three motorcycles intercepted a bus and started quarreling. When Md. Badal, Pintu and other persons who were sitting at the tea shop tried to pacify the matter. Thereafter, 5-6 miscreants went from there and 2-3 miscreants started quarreling with

No.59478 of 2025(2) dt.02-09-2025 2/3 Badal and Pintu, in the meantime, one miscreant called other miscreant with his mobile phone then one miscreant fired 2-3 times due to which informant sustained bullet injury on his leg and Md. Alim sustained bullet injury on his leg hand. Thereafter, the injured were taken to hospital.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is not named in the F.I.R. He has been remanded in this case from Araria Sangram P.S. Case No. 16/2025. There is general and omnibus allegation against the petitioner. The petitioner has one antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 04.04.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Jhanjharpur, Madhubani in connection with Araria

The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
