2. The petitioners seek regular bail in connection with Sadar Excise P.S. Case No. 236 of 2025, for the offence registered under Section 30 (a) of the Bihar Prohibition & Excise Amendment Act.
3. As per the prosecution case, total 135 litres of illicit Nepali country made liquor was recovered from an e-rickshaw. It is alleged that the petitioners were coming on e-rickshaw and they tried to flee away on seeing the police.
4. Learned counsel for the petitioner submits that the petitioners are innocent and have been falsely implicated in this

Nothing has been recovered from the conscious possession of the petitioners. He further submits that the petitioners were neither the driver nor the owner of the seized erickshaw. Petitioners are in jail custody since 22.07.2025, having clean antecedent. Petitioners undertake to cooperate in the trial of the case.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties and period of custody, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court, Madhubani, in connection with Sadar Excise P.S. Case No.236 of 2025.
