The petitioner is accused in connection with Ara Nawada P.S. Case No. 335 of 2016 registered under sections 341, 323, 379, 307, 504/34 of the I.P.C. pending in the Court of C.J.M., Ara.
The allegation against the petitioner is that on the instigation of his father, he opened fire at the informant with intention to kill him causing injury at his right elbow. Submission is that petitioner is innocent and is in custody since 26.09.2016. The injury caused by the petitioner is not on the vital part of the body.
Learned A.P.P. appearing on the behalf of the State
Patna High Court Cr.Misc. No.50563 of 2016 (4) dt.09-02-2017 2/2 opposed the prayer of the petitioner with submission that the injury caused by the petitioner is at the right elbow with intention to kill him.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. However, petitioner may renew his prayer for bail after framing of charge.
