The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 304, 420, 34 of the Indian Penal Code.

As per prosecution case, the allegation against the accused person including the petitioner is that they have done operation of the informant's Sarhaj and due to ill treatment and negligence she died.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to personal grudge. The informant and his family members were present and during investigation nothing found with regard to ill treatment

As per Supplementary Affidavit, the petitioner is enrolled in Council of Government Ayurvedic and Unani Medicine, Bihar since 31.03.1999 and he has certificate of the same. It is further submitted that earlier other family members of the informant were treated by the same doctors but no any compliant was made by them. The petitioner has got n criminal antecedent. Moreover, he has been languishing in judicial custody since 12.06.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Shahpur P.S. Case No. 205 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court.
