JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-02-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application arises out of Jandaha P.S. Case No. 292 of 2013, disclosing offences punishable under Sections 498A/34 of the Indian Penal Code and Sections 3 / 4 of the Dowry Prohibition Act.

It is stated at the Bar that the petitioner and Opposite party No.2 are living together peacefully.

Considering the nature of accusation and developments which have taken place during the pendency of this application, this application is allowed. Let the petitioner above-named in the event of his arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.47508 of 2014 (6) dt.10-02-2016 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Vaishali at Hazipur in connection with Jandaha P.S. Case No. 292 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
