The petitioner seeks bail in a case registered under Section 379/411 of the Indian Penal Code.

Allegedly, the petitioner was apprehended while he was stealthily taking away the motorcycle.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 10-05-2019. Charge sheet has already been submitted. The petitioner has been made accused in the present case due to mistake of fact. The allegation, made in the FIR is denied by the petitioner. The petitioner has already remained in custody for three months.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sushant Sagar, learned Judicial Magistrate-IInd Class, Saran at Chapra in connection with Bhagwan Bazar P.S.
