JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 31-08-2017 The present writ petition has been filed for a direction to the respondents to release the admissible and sanctioned pay scale of Rs. 5500175-9000/- to the petitioner with effect from 09.08.1999 on his getting the second Assured Career Progression Scheme (ACP).

2. By I.A. No. 2871 of 2017 the petitioner has further prayed for grant and payment of 3rd ACP/MACP with consequential benefits with effect from 01.01.2009 in the grade pay of Rs. 4800/- which has been paid to similarly situated persons.

3. At the very outset this Court takes note of the statement made in the counter affidavit filed on behalf of the respondent nos. 2 to 5, in para 5 whereof it is stated that the District Screening Committee on 28.04.2017 has passed proposal for grant of 3rd MACP with effect from 01.01.2009 and thereafter order dated 29.04.2017 has been passed for payment of arrears of

Patna High Court CWJC No.16820 of 2008 dt.31-08-2017 balance amount to the petitioner. It is further stated that such arrears of balance amount was for Rs. 3,048/- which has been paid into the bank account of the petitioner through bill no. 07/2017-18. It is further stated that the Accountant General, Bihar has been requested to revise the pension of the petitioner in the light of 3rd MACP granted to him.

4. Learned counsel for the petitioner accepts the stand of the respondents as above and the grievance of the petitioner stands redressed.
