There is none on behalf of the State.

However, a counter affidavit on their behalf has been filed, duly sworn by the Under Secretary, Education Department, Government of Bihar.

On the basis of the inspection report and the materials, the Education Department, despite the recommendation of the University, has rejected the claim for recognition/affiliation and the said decision is under challenge in the present writ application. Since such an exercise was carried out much earlier and there could have been improvement, as is the stand of the learned Senior Counsel, a fresh inspection should be carried out by an honest upright officer and based on the new recommendation, an appropriate

Patna High Court CWJC No.21565 of 2014 dt.25-08-2015 2/2 decision may be taken. An early decision would be in the interest of one and all.

The writ application stands disposed of with the above observation.
