The petitioner seeks bail in connection with Chanan P.S. Case No. 18 of 2017, registered under Section 147, 148, 149, 341, 323, 325, 307, 504 and 506 of the Indian Penal Code. The accusation is that six persons named in the F.I.R. including the petitioner, came near the informant and forbade putting roof on the hut. On protest, Kedar Mahto assaulted the father of the informant through iron rod and other accused threw his father from the roof of the hut. At that time, Kedar Mahto and Ganesh Mahto assaulted informant by mean of iron rod and this petitioner caused fracture injury to the Chandan Kumar, brother of the informant.
Learned counsel for the petitioner submits that while
Patna High Court Cr.Misc. No.22922 of 2017 (3) dt.05-07-2017 2/2 allegation has been made to cause injury to the brother of the informant, but the injuries as found on the person of the brother of the informant is simple in nature. Further submission is that the occurrence took place due to land dispute in which petitioner side also sustained injuries and on the basis of the fardbeyan of co-accused Kedar Mahto Chanan P.S. Case No. 22 of 2017 under Sections 147, 148, 149, 323, 324, 354, 307, 379, 504 and 506 of the Indian Penal Code. Moreover, the petitioner having no criminal antecedent is in custody since 21.03.2017. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M-1st, Lakhisarai in connection with Chanan P.S. Case No. 18 of 2017.
