====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 17-01-2025 Heard learned counsel for the petitioners as well as the learned APP for the State.
2. The petitioners apprehend their arrest in connection with Gamhariya P.S. Case No. 104 of 2013, registered for the offences punishable under Sections 302, 120(B) and 34 of the Indian Penal Code.
3. The allegation on the petitioner and other accused persons is that they got a sale deed executed from the deceased. The deceased went to the house of the accused persons to demand the consideration money. Later on the dead body was found.
4. Learned Counsel for the petitioners has submitted that they are innocent and have falsely been implicated. Other co-accused persons on the same ground has been granted
Patna High Court CR. MISC. No.65201 of 2024(5) dt.17-01-2025 2/2 anticipatory bail. The Investigating Authorities did not find evidence against the petitioners and the final form was submitted against them.
5. On the other hand, the learned APP has opposed the prayer for bail.
6. Considering the above-mentioned facts and circumstances and also considering that on similar footing coaccused, namely, Pawan Yadav @ Pawan Kr. Yadav and Bhabesh Jha have been granted anticipatory bail vide order dated 15.12.2014 in Cr. Misc. No. 44181 of 2014, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Madhepura in connection with Gamhariya P.S. Case No. 104 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
