JUSTICE JYOTI SARAN ORAL ORDER 30-05-2018 Heard Mr. Shri Prakash Srivastava, learned counsel for the petitioner and the learned counsel for the respondents. The petitioner is aggrieved because having succeeded in the selection process initiated by the respondent Bank of India for recruitment of Officers in General Banking Stream, he was not allowed to appear in the interview and the reason therefor finds mentioned at paragraph 3 of the counter affidavit of the Bank in which it is stated that although qualification prescribed for the Officer- Credit (JMGS-I) appearing at Post Code- 001 required a
Patna High Court CWJC No.18565 of 2016 (5) dt.30-05-2018 candidate to possess a B.Com Degree in a three year full time programme, the petitioner did not fulfil this qualification because he had obtained degree from Nalanda Open University, which is not a three year full time programme.
The position is not disputed by Mr. Srivastava, although he endeavours to submit that the B.Com degree granted by the Nalanda Open University ought to have been recognized by the Bank for the purpose.
Having heard learned counsel for the parties and taking note of the stipulations present in the advertisement, a copy of which is present at Annexure 1, which requires a candidate to possess a B.Com degree after pursuing a three year full time programme, that it is not disputed that the degree obtained by the petitioner is from the Nalanda Open University which is admittedly not a three year full time programme, the discretion exercised by the Bank in not allowing the petitioner to participate in the interview on grounds of failing in eligibility qualification cannot be faulted to require any interference. The writ petition is disposed of.
