2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 302 and 120B/34 of the Indian Penal Code, registered in connection with Gamahariya P.S. Case No. 104 of 2013.
3. The allegation against the petitioner along with others is of killing the son of the informant under conspiracy.
4. The learned counsel for the petitioner has submitted that he has been falsely implicated in this case and has committed no offence. He submitted that the Investigating Officer submitted Final Form in favour of the petitioner but the learned Magistrate differing with the same and took cognizance
Patna High Court CR. MISC. No.65386 of 2024(2) dt.19-09-2024 2/2 against the petitioner on 03.12.2018. Petitioner is a resident of another village, Police Station and District. He further submitted that the other co-accused has already been granted anticipatory bail by a Co-ordinate Bench vide order dated 15.12.2014 passed in Cr. Misc. No. 44181 of 2014. Moreover, petitioner is a person of clean antecedent and he is in custody since 20.06.2024.
5. Learned APP for the State has opposed the prayer of bail.
6. Considering the above facts and circumstances of the case, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned in connection with Gamahariya P.S. Case No. 104 of 2013, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the Court.
8. Petitioner shall remain physically present each and every date as directed by the Court, till framing of charge.
