2. The petitioner has preferred this application for grant of regular bail in connection with Bihpur P.S. Case No. 157 of 2024 registered for the offences punishable u/s 302, 147, 149, 341, 323, 325, 307 of the I.P.C.

3. As per the prosecution case, the petitioner and other co-accused persons are alleged to have assaulted the husband of the informant by means of deadly weapons, due to which he sustained grievous injuries and subsequently, he died during the course of treatment.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.65990 of 2024(7) dt.08-05-2025 2/2 this case. It is further submitted that an F.I.R. has been lodged against eleven accused persons. It is also submitted that there is no specific allegation against the petitioner, rather, the allegation against the petitioner is general and omnibus. It is next submitted that similarly situated co-accused person has already been granted bail by a co-ordinate Bench of this Court vide order dated 01.05.2025 passed in Cr. Misc. No. 23709 of 2025. It is lastly submitted that the petitioner has one criminal antecedent and is in custody since 27.04.2024.

5. Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for bail of the petitioner.

6. Considering the aforesaid submissions of the parties, let the petitioner above-named, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Naugachia, Bhagalpur, in connection with Bihpur P.S. Case No. 157 of 2024.

7. The application stands allowed.
