Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Mohiuddinnagar P.S. Case No. 177 of 2022, lodged under Sections 302, 201/34 of the Indian Penal Code. As per prosecution case, it has come in the F.I.R. that the Police has received information that a dead body has been recovered and people want to take the dead body through motorcycle. Thereafter, the patrolling car reached and from where 3 persons were apprehended including the present petitioner, whereas name of 4th persons has also come, whose

From the contents of F.I.R., it transpires that the said motorcycle, on which, dead body and the weapons used in killing were seized by the Police. It has been intimated that one accused namely Md. Sohel is accused of Mohiuddinngar P.S. Case No. 36 of 2021 dated 17.02.2021 under Section 376 of I.P.C.. It is stated that the case is directed to be filed against 4 named persons.

Learned counsel for the petitioner submits that there is nothing specific against the petitioner save and except that she was alleged to be present at a nearby place of dead body. He further submits that antecedent of petitioner is clean and she is in custody since 16.07.2022. He also submits that save and except that there is a suspicion lies against the petitioner, there is no cogent material available on the record of the case. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-
