JUSTICE BIRENDRA KUMAR ORAL ORDER 17-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in Nabinagar P.S.Case No.145/16 for the offences under Sections 409 and 420 of the I.P.C.
The petitioner was Headmaster of the school at the relevant time.and the Project of construction work of school building was assigned to the petitioner for which Rs.13/- lacs was sanctioned. As per the F.I.R. the petitioner withdrew the money. However, he did not complete the work within the relevant time. As such, along with the interest Rs.20,38.197/- has been shown as due against the petitioner which is yet to be recovered. The petitioner has filed supplementary affidavit
Patna High Court Cr.Misc. No.50589 of 2016 (4) dt.17-01-2017 2/2 enclosing the statement of withdrawal and expenses wherein it is stated that the petitioner withdrew Rs.4,73,700/- and up to through cheque to different persons, i.e., to the supplier of building material and labour vide the statement as contained in Annexure-6 and 6/1 to this application.
Submission of the petitioner is that since the petitioner was transferred, the work could not be completed.. Considering the nature of allegation, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today be released on bail on furnishing bail bond of Rs.10,000/-with two sureties of the like amount each to the satisfaction of A.C..J.M., Aurangabad, in Nabinagar P.S. Case No.145/16 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
