Patna High Court Cr.Misc. No.51937 of 2014 dt.24-01-2018 This petition has been filed for quashing the order dated 14-042014/15-04-2014 passed by Sri Anil Kumar Ram, learned Judicial Magistrate-Ist Class, Patna in S.K. Puri P.S. Case No. 04 of 2009 by which and whereunder, the learned Magistrate has framed charge against the petitioners for the offence under Sections-341/34, 323/34, 504/34, 506/34 and 379/34 of the Indian Penal Code. Counsel for petitioners and opposite party No. 2 have appeared and filed I.A. No. 2720 of 2017 stating therein that both parties have entered into compromise and the matter has been settled between the parties and they do not want to proceed further in the case.
This court is of the view that since charge has already been framed in this case, in that event, both parties will appear in the court below and file a petition stating therein that compromise has taken place between the parties. The court below will dispose of the case in accordance with law as early as possible, preferably, within a period of three months from the date of filing of such petition after recording the evidence of both parties.
