JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 26-09-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363 and 365 of the Indian Penal Code.

It is a case of abduction of the daughter of the informant.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. Petitioner has clean antecedent.

Learned APP appearing for the State opposed the anticipatory bail and submitted that from perusal of the statement of the victim girl recorded under Section 164 of the Cr.P.C. vide para-45 of the case diary, it appears that she

No.71805 of 2021(3) dt.26-09-2022 2/2 disclosed the complicity of the petitioner that he had taken away her forcefully by a vehicle and he confined her in a room, thereafter, he had taken away her to Patna. He further submits that the petitioner is named in the FIR and during course of investigation, witnesses have supported the prosecution case. After considering the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner is hereby rejected.

However, the petitioner is directed to surrender before the court below and pray for regular bail.
