This is the second attempt of the appellant to approach before this Court for bail. Earlier, vide detailed order dated 19.05.2022 passed in Cr. Appeal (S.J.) No. 39 of 2022, the prayer for bail of the appellant was rejected with a direction to the learned Court below to conclude the trial. Vide order dated 23.11.2022, a report was called for from the learned Court below regarding the stage of the trial and the time likely to be taken in conclusion of the trial. In compliance thereof, a report dated 30.11.2022 has been sent by the learned Exclusive Special Judge SC/ST, Gaya, which is at Flag 'L' to this appeal. In his report, the learned Judge has, inter alia, stated that there are eight prosecution witnesses as per the

Patna High Court CR. APP (SJ) No.3623 of 2022(3) dt.04-01-2023 2/2 charge-sheet. Four prosecution witnesses have been examined in this case as yet. The Court has been vacant since 02.06.2022. Considering the facts aforesaid, I am not inclined to enlarge the appellant on bail. The prayer for bail is hereby once again rejected.
