The petitioner seeks bail in connection with Chhauradano P.S. Case no. 38 of 2016 registered for the offence punishable under Sections 147, 148, 149, 353, 307, 120-B of the Indian Penal Code and Section 27 of the Arms Act. The informant of this case is a S.I., who caught one Kamlesh Kumar Sah from the place of occurrence where he along with other accuseds had assembled to commit some crime. The name of this petitioner appeared in confessional statement of said Kamlesh Kumar Sah. The similarly situated co-accused namely, Pukar Rai has been allowed anticipatory bail vide order dated 29.11.2016 passed in Cr. Misc. no. 43493 of 2016. The other co-

Patna High Court Cr.Misc. No.32962 of 2017 (2) dt.20-07-2017 accused namely, Shribhagwan Rai has been allowed bail vide order dated 18.03.2017 passed in Cr. Misc. no. 13096 of 2017. The case of this petitioner stands on similar footing as his name was disclosed by the co-accuseds. The petitioner is in custody since 28.02.2017.

Considering the case of this petitioner on similar footing, his prayer of bail is allowed. He (Arjun Giri) is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Raxaul at Motihari, East Champaran in connection with Chhauradano P.S. Case no. 38 of 2016.
