The application is for grant of bail for the offence under Sections 323 and 307 of the Indian Penal Code as well as Section 27 of the Arms Act.
It has been submitted on behalf of the petitioner that the petitioner is not named in the FIR and his name transpired after three months of the lodging of the FIR and that too on the suspicion on the ground that there was love affair between the petitioner and the daughter-in-law of the informant. It has also been submitted on behalf of the petitioner that the petitioner has no criminal antecedent and he is in custody since 26.08.2016. Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.52115 of 2016 (3) dt.21-12-2016 2/2 Having heard both sides. In view of the fact that the name of the petitioner transpired after three months of the date of occurrence and that too on the basis of suspicion, let petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of CJM, Jamui in connection with Khaira P.S.Case No.93 of 2013.
