The petitioners seek bail in Sessions Trial No. 406 of 2015/C.I.S. No. 3709 of 2015, arising out of Bettiah Muffasil (Manuapul) P.S. Case No. 121 of 2015, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code. The prayer for bail of the petitioners was earlier rejected vide order dated 02.07.2015 passed in Cr. Misc. No. 18808 of 2015. The petitioners again filed this petition for grant of bail on the ground that the trial has not been concluded. A report was called for and the report sent by learned Additional Sessions Judge-I, Bettiah, West Champaran disclosed that the evidence of the prosecution has been closed. Patna High Court Cr.Misc. No.23679 of 2017 (3) dt.05-07-2017 2/2 persons have been taken and the case is pending for argument. Considering the facts aforesaid, I am not inclined to enlarge the petitioners above named on bail. Accordingly, the same is rejected.
