2. The petitioner seeks regular bail in Sakatpur P.S. Case No. 39 of 2024 registered for the offence punishable under Section-30(a) of the Bihar Prohibition and Excise Act, 2022.

3. Allegedly, on the tip off, a pick up van and one motorcycle were seized by the informant and on search, 810 litres of illegal liquor is said to have been recovered from the said vehicles.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated

Patna High Court CR. MISC. No.64307 of 2024(2) dt.18-09-2024 2/2 in this case. There is no independent witness to the occurrence. It has further been submitted that nothing incriminating has been recovered from conscious possession of the petitioner. The petitioner is under incarceration since 22-06-2024.

5. Learned APP has opposed the prayer for bail and submitted that the petitioner has got criminal antecedent of three cases.

6. Considering the aforesaid facts and circumstances, specially, the criminal antecedent, the petitioner named above, is directed to furnish bail bond after five months from today and on doing so, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise-II, Excise Act, Darbhanga in connection with Sakatpur P.S. Case No. 39 of 2024.
