This is the second attempt for grant of bail on behalf of the petitioner. Earlier, by order dated 24-10-2016 passed in Cr. Misc. No. 40764 of 2016, the prayer for bail of the petitioner was rejected.

It was submitted by learned counsel for the petitioner that though, in the case, the petitioner was made accused on the basis of confessional statement of the accused, none had seen the occurrence. He submits that the petitioner is in custody since 03-05-2016 without any progress in the case. By way of referring to statement made in paragraph - 2 of the supplementary affidavit

Patna High Court Cr.Misc. No.23120 of 2017 (4) dt.05-07-2017 2/2 filed on 29th June, 2017, learned counsel for the petitioner submits that till date case is pending before the learned Magistrate and it has not been committed to the court of sessions. Considering the fact that petitioner is in custody without adequate progress in the case and case has not been committed to the court of sessions as well as the fact that he was made accused on the basis of confessional statement of the accused, there is no reason to further detain the petitioner. Let the petitioner namely Satrudhan Tanti be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri A.K. Rai, learned J.M. Ist Class, Patna City, Distt. Patna in connection with Khusrupur P.S. Case No. 70 of 2016.
