Heard learned counsel for the petitioner, learned A.P.P. for the State, Shri. Rabindra Kumar and learned counsel appearing on behalf of the informant.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 304B and 34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is a person with clean antecedents and has been falsely implicated in the instant case. It is next submitted that Gulabiya Devi had approached this court seeking anticipatory bail by filing Cr. Misc No. 51838 of 2024 and the same was allowed by an order dated 23-9-2024. It is further submitted that Gulabiya Devi is the mother-in-law of the deceased. It is next submitted that it has been specifically pleaded in the anticipatory bail application that the petitioner is not even remotely related to the family of the

It is next submitted that the petitioner, being a co-villager, came to be implicated only for the reason that he had mediated the marriage of the deceased with the son of Gulabiya Devi, as such, the informant also implicated him. 4.

The learned counsel appearing on behalf of the informant opposes the anticipatory bail application but then fairly submits that petitioner is not related to the family of the husband of the deceased and he is co-villager and had mediated the marriage of the deceased with the son of Gulabiya Devi. 5.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Saraiya P.S. Case No. 62/2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) SUMIT/- U T
