JUSTICE SUDHIR SINGH ORAL ORDER 20-05-2015 The petitioner is apprehending his arrest in connection with Complaint Case No. 1705(C) of 2013 for the offences instituted under Section 498(A) of the Indian Penal Code. Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that the marriage of complainant Ranu Kumari was solemnized on 30.11.2011 with Rajendra Purushottam alias Raj(Petitioner) according to Hindu rites and customs and complainant went to her matrimonial home. She further alleged that on the occasion of marriage ceremony, the parents and relatives of the complainant paid Rs. 5,50,000/- and other house hold items ornaments to the petitioner and his parents. Complainant has further alleged that the petitioner dropped her Delhi but there also he tortured the complainant. The complainant has further alleged that the petitioner had established illicit relation with a lady. Complainant has further alleged that her father paid Rs.3.50 lacs to the petitioner at the time of Grih-Pravesh also. Petitioner also told that she is characterless lady. Petitioner and others tried to electrocute the complainant with intention to kill and in the night all the accused persons tried to immolate her but some how she saved. It has been submitted on behalf of the petitioner that the petitioner is the husband of the complainant.

It has further been submitted that the petitioner has been working as a teacher in a Primary School at Delhi. The complainant has also filed a Maintenance Case No. 90 of 2013. It has further been submitted that the complainant is not willing to stay with the petitioner and for the said reason, she has brought the present prosecution against the petitioner. It has further been submitted on behalf of the petitioner that the petitioner is ready to deposit amount of Rs.2500/- each month in the court below which shall be released in favour of the complainant.

On behalf of the State, it has been submitted that the

Considering the fact that the petitioner is ready to deposit amount of Rs. 2,500/- each month in the court below which shall be released in favour of the complainant, let the above named, petitioner, be released on bail in the event of his arrest or surrender before the learned court below within a period of eight weeks from today in connection with Complaint Case No. 1705C of 2013 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Begusarai, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
