JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-07-2017 From perusal of the record of Cr.Misc.No.20701 of 2017 as well as the present case it appears that one bail application has been filed on 26.4.2017 and the present has been filed on 29.6.2017 by the same petitioner in similar P.S.Case number, being Bihta P.S.Case No. 913 of 2016 and in Cr.Misc.No.20701 of 2017 bail has been granted to the petitioner has been granted bail by this Court on 9.5.2017.

Submission of learned counsel for the petitioner is that in the present case affidavit has been sworn by wife of the petitioner, whereas in Cr.Misc.No. 20701 of 2017 affidavit has been sworn by cousin of the petitioner. However, due to some confusion the present application has been filed but no such statement has been made in subsequent bail application. Learned

Patna High Court Cr.Misc. No.29566 of 2017 (4) dt.19-07-2017 2/2 counsel seeks permission to withdraw the present application. Considering the facts and circumstances, in spite of the fact that matter is very serious but as the deponent is lady, as such, she is left with warning and to be cautious in future. Accordingly, this application is dismissed as withdrawn.
