This application is for grant of regular bail in connection with Chandauti P.S.Case No.99 of 2013, registered for the offences under Sections 302 and 34 and of the Indian Penal Code. Allegation against the petitioner is that he committed murder of his father. It is submitted on behalf of the petitioners that it is a false and concocted case, which will appear from para 11 and 12 of the case diary that nobody was eye witness of the occurrence and he has been falsely implicated in this case due to property dispute and a petition to that effect has also been filed by the wife of the deceased, stating that the petitioner has been falsely implicated in this case.

Heard learned A.P.P. also, who has opposed the prayer for

Patna High Court Cr.Misc. No.23936 of 2017 (3) dt.05-07-2017 2/2 bail, stating that there is direct allegation against this petitioner. Having heard both sides and considering the facts and circumstances as stated above and also considering the fact that now the trial has commenced. In such view of the matter, learned trial court is directed to expedite the trial of the petitioner on regular basis and the Sr.S.P., Gaya is also directed to ensure presence of the witnesses in this case on each and every date so that the case may be disposed of within the period as specific and the learned court will try to conclude it within a period of seven months.

With the aforesaid observation, this application is dismissed.
