2. The petitioner seeks bail in connection with Kateya P.S. Case No. 205 of 2025, instituted for the offences punishable under Sections 317(5), 111 of the Bharatiya Nyaya Sanhita, 2023 and Section 30(a) of the Bihar Prohibition and Excise Act.
3. The petitioner has earlier moved before a Coordinate Bench of this Court with a prayer for anticipatory bail which was dismissed as withdrawn vide order dated 01.07.2025 passed in Cr. Misc. No. 40820 of 2025.
4. As per prosecution case, the police has recovered total 270 liters illicit liquor from car.
5. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.59434 of 2025(2) dt.22-08-2025 2/3 petitioner is innocent and has falsely been implicated in the present case merely on the basis of suspicion. Nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner has got no concern with the alleged recovery of liquor. Learned counsel for the petitioner also submits that the petitioner was not arrested on spot. Name of the petitioner has transpired in this case on the basis of confessional statement made by co-accused person recorded before the police which has got no evidentiary value in the eye of law. Save and except disclosures made by the arrested persons, there is nothing adverse against the petitioner. The petitioner is in custody since 01.07.2025 and has got two criminal antecedents.
The petitioner has no concern with the alleged occurrence. The petitioner has also no concern with the alleged Maruti Suzuki Swift Dzire VDI car bearing Regd. No. UP57X1718 which belongs to the three arrested accused persons, as admitted by them. The petitioner has no concern with the apprehended three accused persons. There is no compliance of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. Learned counsel for the petitioner further submits that the co-accused Madan Singh has already been granted bail by this Court vide order dated 02.07.2025 passed in Cr. Misc.

6. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.
7. Considering the aforesaid facts and circumstances of the case and the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
8. Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Kateya P.S. Case No. 205 of 2025.
