The petitioner is in custody in connection with Sabour (Goradih) P.S. Case No. 328 of 2014 for the offences punishable under sections 25(1), (1-AA), 25(1-(1), (1-b)c, 26, 28, 35 of the Arms Act.

The petitioner was apprehended in this case on the suspicion that the petitioner is involved in running a mini gun factory.

It appears that the petitioner was apprehended on 28.02.2017, not at the spot. He was not named even in the FIR. The FIR was lodged against 10-15 unknown persons and in

Patna High Court Cr.Misc. No.27019 of 2017 (3) dt.06-07-2017 2/2 paragraph 3 of this petition, the statement has been made on oath that the petitioner has clear antecedent.

Having regard to the fact that the petitioner was not apprehended at the spot and the case was registered against unknown and as per the statement made in paragraph 3 of this petition that the petitioner has clear antecedent, I am inclined to enlarge the petitioner on bail.

Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate,-X, Bhagalpur or Successor Court in connection with Sabour (Goradih) P.S. Case No. 328 of 2014, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and he will not, in any manner, influence the witnesses.
