JUSTICE BIRENDRA KUMAR ORAL ORDER 19-12-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 353, 504, 427 and 379/34 of the Indian Penal Code. Petitioner No. 1 Bijendra Ram was a teacher where the informant was in-charge Principal. The petitioner no. 1 was, allegedly, absent for few days and when he came to the school wanted to put his signature on the attendance register of the period of his absence. On refusal by the informant, the petitioner no. 1 Bijendra Ram and his wife Sulekha Kumari (petitioner no. 2) abused and committed assault.

Submission is that for some different dispute relating to misappropriation of amount of mid-day meal by the

Patna High Court Cr.Misc. No.51004 of 2016 (2) dt.19-12-2016 2/2 Headmaster, false case has been lodged. The petitioners have got no criminal antecedent.

Considering the facts and circumstances, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Supaul/Successor Court in connection with Jadia Police Station Case No. 33 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
