The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 47 of the Bihar Excise (Amendment) Act, 2016.

Illegal country made liquor was recovered from the vehicle of this petitioner.

Submission is that the petitioner was not present at the time of recovery and co-accused Manoj Yadav, having similar allegation, has already been allowed anticipatory bail by a Coordinate Bench of this Court in Cr. Misc. No. 51248 of 2016 on 05.12.2016.

Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty

Patna High Court Cr.Misc. No.51047 of 2016 (2) dt.19-12-2016 2/2 days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Saran at Chapra/Successor Court in connection with Manjhi Police Station Case No. 172 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
