Case diary is available wherefrom it is apparent that petitioner no.3, Kanti Devi has not been sent for trial. So far status of petitioner no. 1, Mohan Ram and petitioner no.2, Bachchi Devi are concerned, from paragraphs-82 and 83 of the case diary, it is evident that they appeared before the I.O. and were let off on police bail.

That being so, the instant petition for anticipatory bail is found non maintainable and is, accordingly, rejected. However, since petitioners no. 1 and 2 are on police bail, the learned lower court will consider the same after their appearance on post cognizance stage.
