2. At the outset, learned counsel for the petitioner prays for and is granted permission to make correction in paragraph No. 1 of bail petition .
3 . Petitioner seeks regular bail in case registered for the offences punishable under Sections 329 (3) , 115 ( 2 ), 74, 303 ( 2 ), 324 ( 4 ), 352, 351 ( 2 ), 109 (1) and 351 (3) of BNS.
4. The prosecution case , in brief, is that informant namely , Mohina Khatoon alleged that on 03.09.2024 , all the F.I.R. named accused persons including this petitioner armed with lathi, danda came and abused informant and thereafter, on the order of this petitioner, other co-accused persons assaulted

Learned counsel for the petitioner submitted that specific accusation of assault is against other co-accused persons. So far as this petitioner is concerned, he is only alleged to be order giver. Allegation of assault is general and omnibus against him. No specific overt act is alleged against him. Petitioner claims clean antecedent and is in custody since 30.06.2025 .
6. Mr. Sandeep Kumar Gautam, learned counsel for the informant as well as A.P.P. for the State vehemently opposed the bail application and submitted that deceased sustained multiple injuries and died during course of treatment.
7. Considering the aforesaid facts, materials available on record, period of custody , clean antecedent of this petitioner and other circumstances of the case , the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Begusarai in connection with Balia P . S. Case No. 292 of 2024 .
