JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 08-09-2017 Inter alia contending that various provisions of the Right of Children to Free and Compulsory Education Act, 2009 is not being implemented properly and the requirement of Sections 19 and 25 are not being fulfilled, this petition has been filed in public interest seeking a mandamus to the State Government for taking steps for implementing the provisions of the Act in question.

From Paragraph 9 onwards in the counter affidavit filed by the State Government, various steps taken in this regard

Patna High Court CWJC No.19026 of 2016 dt.08-09-2017 2/2 have been indicated. It is also stated that further steps are being taken for implementation of the scheme.

Keeping in view the counter affidavit submitted by the respondents, we direct the respondent State Government to proceed to implement the scheme in letter and spirit and take steps as are indicated in the counter affidavit within a reasonable period of time, preferably within 6 to 8 months and ensure that the provisions of the Right to Education Act is impelemented in its letter and spirit.

With the aforesaid, the writ petition stands disposed of.
