JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2020 This application, for grant of anticipatory bail, arises out of Barbigha P.S. Case No. 367 of 2018 (POCSO Case No. 52 of 2018), disclosing offences under Sections 354(A)(B) of the Indian Penal Code.

Prosecution case is that while the daughter of the informant was going to attend the coaching institute, three miscreants came on motorcycle and pulled her Dupatta and fled away. F.I.R. was lodged against unknown later on petitioner has been made accused in this case as the motorcycle used in the occurrence was in the name of his mother.

Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been implicated in this case only on the basis of suspicion and he is ready to abide by any condition imposed on him.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Additional District & Sessions Judge, Sheikhpura, in connection with Barbigha P.S. Case No. 367 of 2018 (POCSO Case No. 52 of 2018), subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
