JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2016 Heard learned counsel for the petitioners as well as learned APP for the State.

The petitioners seek anticipatory bail in connection with Runnisaidpur P.S. Case No. 195 of 2015 instituted for the offences punishable under Sections 420, 467, 468, 409, 406 and 120-B/34 of the Indian Penal Code.

The allegation against the petitioners is that on the basis of false Land Possession Certificate, the petitioners have obtained amount of the paddy as submitted to the Government. It has been submitted on behalf of the petitioners that as a matter of fact, the land was in the name of the father as

No.52910 of 2016 (2) dt.21-12-2016 2/3 both sons are legal heirs of the land is sufficient and, as such, the petitioners have separately submitted Land Possession Certificate and got the amount in view of the paddy supplied to the Government and, as such, in view of the F.I.R., the allegation against the petitioners are false. It has also been submitted that the person having similar circumstance has already been granted bail vide order dated 16.12.2015 by the co-ordinate Bench of this Court in Criminal Miscellaneous No. 44023 of 2015.

Having heard both sides, in view of the fact stated above as well as other co-accused person having similar circumstance has already been granted bail vide order dated 16.12.2015 by the co-ordinate Bench of this Court in Criminal Miscellaneous No. 44023 of 2015, let the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No. 195 of 2015, on
