JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Jamui P.S. Case No. 338 of 2019 registered for the offences punishable under Sections 147, 341, 323, 379, 504, 427 and 307 of the Indian Penal Code.

As per FIR allegation is that petitioner No.1 assaulted by means of rod on the head of informant, causing injury on his nose and there is allegation against petitioner Nos. 2 and 3 that they also assaulted the informant and snatched Rs.3000/- from him. Submission of learned counsel for the petitioners is that allegation of assault against petitioner Nos. 2 and 3 is general in nature and occurrence took place with respect to playing of cricket and so far petitioner No.1 is concerned, except one injury, about which opinion was kept reserved, other injuries are simple in nature

In view of above facts and circumstances, let petitioner Nos. 2 and 3, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui, in connection with Jamui P.S. Case No. 338 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.

So far petitioner No.1 is concerned, in the facts and circumstances, his prayer for anticipatory bail is rejected. He may surrender and pray for regular bail.

With the above observation, this application is disposed of.
