ANJANA MISHRA ORAL ORDER 26-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 16.06.2019 in connection with Chausa P.S. Case No.164 of 2019 registered for the offence under Section 392 of the Indian Penal Code. Learned counsel for the petitioner submits that the entire allegation is false and mischievous and the informant and the petitioners are business partners and it is only because of the reason that he was not part of the gang and the act of snatching was made by other person, that the petitioner has been implicated in the present case. It is further submitted that the petitioner has no criminal antecedents and there is nothing on record to indicate that the petitioner was part or in any way connected with those person who has snatched the bag of the

It is further submitted that the F.I.R. in the present case has been lodged after two days of the alleged occurrence, for which no plausible explanation has been offered. Considering the aforementioned facts and circumstances and that the petitioner has no criminal history, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Uda-Kishunganj, Madhepura, in connection with Chausa P.S. Case No.164 of 2019.
